These General Conditions are intended to regulate the Terms and Conditions by which Ânima Durius, commercial designation for the tourism area of MGE, Lda, legal person with VAT Number 507 853 890 and headquarters at Quinta dos Poços, Valdigem, 5100-835 Lamego, (henceforth “Ânima Durius”) is governed.

The activity of Ânima Durius consists of providing a set of maritime tourist services. This platform allows the user, who is assigned the status of customer, to book and purchase these same services.

The use of the Ânima Durius website implies acceptance and full agreement with all the parameters present in the Terms and Conditions described here, as well as the Privacy Policy in force when accessing www.animadurius.pt.

If you do not accept, in whole or in part, any of the stipulated conditions, you should not make a reservation on this platform. By accessing the Ânima Durius website, you are committing and taking responsibility for respecting the conditions determined on this page and on the Privacy Policy.

Ânima Durius reserves the right to update and change these Terms and Conditions without prior notice.

Information About Services

Ânima Durius undertakes to provide all information regarding the services it provides in a clear manner and to correct possible errors that may occur as soon as possible.

Detailed information about the company, the services it provides, as well as a description of the vessels, accompanied by images, are mentioned on this website. The different contact methods can also be found.

Ânima Durius reserves the right to refuse the provision of a service to any person who has an altered mental or psychological state and who could jeopardize their own safety, that of their group, the sailors or the vessels, with the return of the value of the returned service, in full or in part, depending on each case.

Ânima Durius is not responsible for late arrivals. In this case, we wait for the duration of the contracted service and conclude the service at the previously scheduled time, in order to comply with the rest of the day’s schedule.

A glass of Port or table wine is served to all customers. Water is also available for free. Other drinks and snacks can be ordered when booking.

The customer can bring food and/or drink on board. Ânima Durius provides plates, glasses, openers and corkscrews, as long as these are mentioned in the “remarks” field when booking.

All vessels comply with the legal requirements in terms of insurance and inspections required by Portuguese legislation. Life jackets for babies, children and adults are available on all vessels.

Minors under 18 years of age must be accompanied by a parent or responsible adult.

Smoking is not allowed in any of the areas inside the boats.

Pets are allowed on board, as long as they do not interfere with the normal operation of the service and/or the hygiene of the vessel.

The vessels do not have an Internet connection.

Purchase Conditions, Payment Methods and Cancellation Policy

All services presented on this site can be purchased according to existing availability.

Prices are shown in Euros (€) and include the appropriate VAT rates, in accordance with current legislation.

No additional fees are charged, the costs associated with bank transactions being assumed by Ânima Durius and included in the prices shown.

Payment can be made through the following methods:

  • Credit card
  • Apple Pay

After completing the payment, you will receive an email with the booking confirmation.

The corresponding invoice/receipt will be issued with the data entered when booking and sent by email after the service has been performed. Entering data is the responsibility of the user.

After issuing the receipt, it is not possible to cancel and/or correct it. If you do not fill in the data for billing, an invoice/receipt will be issued as “Final Consumer”.

The payment processing system is carried out by an external company, and Ânima Durius cannot be held responsible for any failure or fraud that occurs.

Booking Cancellation

The customer can cancel a previously made reservation. To do so, please contact Ânima Durius, by email: [email protected] or by phone: +351 939 922 002.

  • Cancellations up to 7 days before the service – full refund (100%) of the amount paid.
  • Cancellations between 6 and 3 days of the service – partial refund of 50% of the amount paid.
  • Cancellations in less than 48 hours of service – full loss (0%) of the amount paid.

The refund will be made using the same payment method used for the purchase. Banking costs associated with the reversal may be charged to the customer.

Any refund procedure will be processed as provided for in the legislation in force, in Decree of Law n.º 24/2014, its respective amendments and versions of the Diploma.

Ânima Durius reserves the right not to process refunds in cases of fraud or misconduct by the customer, as well as for reasons beyond its control.

If, due to adverse weather conditions, breakdown or mechanical problems of the vessel, accident or medical emergency of the sailors, or any other reason that may be attributed to Ânima Durius and that prevents the performance of the service, the due refund of the amount paid will be refunded in full. to the client.

Intellectual property

The Ânima Durius website is a registered platform, and all contents contained therein are the responsibility of the same.

The domain, contents, images and other information on the site are the property of MGE, Lda, and are protected by copyright and related rights. Any and all use, reproduction, copying or dissemination of these contents is subject to prior approval by MGE, Lda.

Claims

The customer may submit a complaint regarding any service provided by Ânima Durius, by e-mail: [email protected] or the electronic Complaints Book available at the link: https://www.livroreclamacoes.pt/Inicio/.

The Electronic Complaints Book is a digital platform where consumers and users can submit complaints.

Alternative Dispute Resolution

Pursuant to Law 144/2015, of September 8, in the event of a dispute with Ânima Durius, the customer may resort to the following Dispute Resolution entity:

– Porto Consumer Information and Arbitration Center: http://www.cicap.pt;

Ânima Durius has not joined any dispute resolution entity, so it is not bound to accept that any dispute is submitted to any alternative means of dispute resolution.

The competent forum, waiving any other, is the district of Porto.

Disclaimer

When making a reservation, the customer expressly and unequivocally accepts the Terms and Conditions and Privacy Policy in its most updated version. You should not proceed with the reservation if you do not agree with the conditions of this document or if you have doubts that you wish to clarify in advance.

Ânima Durius is not responsible for any information disclosed by third parties, technical failures or any other problems that prevent access and proper functioning of this platform, committing, however, to regularize its operation as soon as possible.

Ânima Durius is not responsible for any direct or indirect damages, including loss of personal property or valuables, resulting from the direct responsibility of customers, with passengers being responsible for the safety and protection of their valuables.
